Terms of Service

1. The Service
Swipes provides a hosted digital business-card and link-in-bio service at swipes.co.za/{username}. By creating an account you agree to these Terms and our Privacy Policy.
2. Your account
You are responsible for the accuracy of the information you provide, for keeping your password confidential, and for everything that happens under your account. You must be 18 years or older, or have the consent of a parent/guardian.
3. Subscription & billing
Swipes is offered on a paid subscription (currently R29 per month, ZAR, VAT inclusive where applicable). Payments are processed by PayFast (Pty) Ltd. By subscribing you authorise Swipes/PayFast to debit the recurring fee until you cancel. Pricing may change on 30 days' notice.
4. Cancellation & no-refund policy
You may cancel your subscription at any time from your dashboard or by emailing us. Cancellation takes effect at the end of the current billing cycle and your page will remain live until that date. All payments made to Swipes are strictly non-refundable. This includes - but is not limited to - monthly subscription fees, partial-month charges, unused time after cancellation, accidental or duplicate payments, and periods during which you did not actively use the service. By subscribing you expressly acknowledge and accept this no-refund policy. The only exception is where a refund is required of us by the Consumer Protection Act, 2008 or other applicable South African law, in which case the statutory remedy will apply.
5. Acceptable use
You agree not to use Swipes to publish content that is unlawful, hateful, infringing, deceptive, sexually explicit involving minors, that promotes violence, or that violates any third party's rights. We may suspend or terminate accounts that breach these rules. We reserve the right to change, reclaim, or rename any username where necessary, including for security, moderation, legal compliance, trademark protection, impersonation, or operational reasons; affected users will be notified in their dashboard.
6. Your content
You retain ownership of the content you upload (profile copy, images, links). You grant Swipes a worldwide, royalty-free licence to host, display, and distribute that content solely to operate the service.
7. Uploads
Image and QR-code uploads are capped at 5 MB per file. We only store images and QR codes; all other call-to-action buttons are external links you control.
8. Availability & changes
We aim for high availability but do not guarantee uninterrupted service. We may add, change, or remove features at any time. We will give reasonable notice of materially adverse changes.
9. Limitation of liability
To the maximum extent permitted by law, Swipes' total liability to you for any claim arising from your use of the service is limited to the fees you paid us in the 3 months before the claim. We are not liable for indirect or consequential loss.
10. Termination & administrative action
You may close your account at any time from your dashboard, which permanently deletes your profile, uploaded files, support tickets and authentication record. We may suspend or close accounts that breach these Terms, fail to pay, or expose us to legal risk. Our administrators may also reset your password (sharing the new credential with you offline), rename your username, or delete your account and related data where necessary to protect the platform, comply with the law, or enforce these Terms. Where reasonably possible, you will be notified in your dashboard.
11. Third-party links & content
Swipes is a platform that lets users publish their own links, copy, images, and contact details. We do not endorse, monitor, or control any third-party websites, products, services, content, or resources that users share through their Swipes page, and we are not responsible or liable for any loss, damage, inaccuracy, or harm arising from your reliance on, access to, or interaction with that third-party content. You access external links at your own risk.
12. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts.
